Before you rely on this

NameChecker surfaces public register data. It is not legal advice and does not constitute trade mark clearance.

  • A green result is not legal clearance to use a name.
  • Trade mark conflict turns on whether marks are deceptively similar, which covers phonetic, visual and conceptual similarity — not just an exact string match. A search like this cannot tell you that.
  • Unregistered rights — passing off, and misleading conduct under s18 of the Australian Consumer Law — are not searchable by any API and are not covered here at all.
  • .com.au availability is not the same as eligibility. It requires an Australian presence (ABN or ACN) and a close connection between the name and the business. Eligibility has to hold for the life of the licence, not just at registration — if the linked ABN or ACN is cancelled, you stop being eligible to hold the domain and it will not renew.
  • ABR trading name data has not been updated since 2012 — treat those entries as historical rather than current.
  • Talk to a trade mark attorney before committing to a name.
